The Travel Industry Council of Ontario ( TICO) is an organization mandated by the Ontario Government
to administer The Ontario Travel Industry Act and an Industry financed Compensation Fund.

Always purchase your services from a TICO registered Ontario travel agency.

All travel agencies and travel wholesalers in Ontario are required to register with TICO under the Travel Industry Act and participate in an industry financed Compensation Fund. When you purchase your travel services from an Ontario registered travel agency, you may be protected by the Ontario Travel Industry Compensation Fund. The Ontario Travel Industry Compensation Fund compensates consumers who paid for, but did not receive travel services because of the bankruptcy or insolvency or an Ontario registered travel agency or an Ontario registered travel wholesaler or due to the cessation of an airline or cruise line.

How do I know if the company I am about to deal with is registered?

When you are in a travel agency, ask to see your travel agent’s certificate of registration. When you purchase your travel services online, be sure to look for the Ontario registration number on the website. Ontario travel retailers are required to display their address, phone number and Ontario registration number on their website. If you are unsure, read the “ About us “, “History” or “Our Company” section on the website to learn about the travel company or you may contact the Travel Industry Council of Ontario to ensure that the company from which you are about to purchase travel services is registered.

What happens if I deal with an unregistered
travel agent?

Should you transact business with an unregistered travel agency, you will forfeit the protection of the Compensation Fund. If in doubt, call the Travel Industry Council of Ontario.

What is covered by the compensation fund?

The Compensation Fund reimburses for the cost of “travel services” when payment was made to a registered Ontario travel agent and services were not provided due to the bankruptcy or insolvency of either a registered Ontario travel agent, a registered Ontario wholesaler or due to the cessation of an airline or cruise line. The Travel Industry Act defines travel service to mean “transportation, sleeping, accomodation or other service for the use of a traveller, tourist of sighseer”.

What is not covered by the compensation fund?

Claims on the Fund must be related to the non-provision of travel services and not to the cost, value or quality of the travel services provided.

Ineligible items include taxes, insurance and the cost of alternate (replacement) travel. Discount certificates, vouchers, prizes, or any goodwill gestures uses in lieu of payment by cash, cheque or credit card are also not eligible for compensation.

Any payment for travel services subjects you to the respective terms and conditions of sale for that product. If you cancel your travel services after any payment, non-refundable payments are not eligible for compansation from the Compensation Fund.

What should I do?

• Be sure that your travel agency is registered. Only purchase travel services through a company holding a retail travel registration with TICO.
• Obtain a receipt and keep receipts and/or invoices for all money transactions. These documents must outline details of the travel services that you have purchased.
• Retain all original documents, including receipts, invoices, returned cheques, credit card slips, credit card statements, in case you need to file a claim.
• Rely on your travel agent. Should problems occur, contact your travel agent immediately, for assistance.
